Minutes of Conservation Commission Public Meeting

Commissioners Present:  Co-Chair Ed Reynolds, Co-Chair Ginie Page, Dottie Dolan, Patrick Winslow, Cyndi Moe, and John DiBlasio.

4:00 - Business Meeting & Conservation Agent's Report

Ginie Page opened the meeting at 4:00 pm.

·       Patrick Winslow reviewed the correspondence / mail.  

·       Agent Greenberg reported she issued a ticket to John Stossel because the final Order of Conditions had not been issued and he did not supply a sieve analysis.  She also ticketed the Roby’s and Cove Gallery on Commercial Street because the Gallery removed some trees/cuttings and placed them on Roby’s property.

·       Jamie Johnson of Harborside Village had been approved for a screened porch in 2006.  When building the porch, they installed framed windows along with the screens, which were not approved.  The Commission stated this is a change in use, although because there is no heat, it would be considered three-season.  Marie Hollis stated the Building Inspector had allowed screens with plexiglass in the past.  Cyndi Moe recommended adding stone along the edge of the overhang to avoid water build up.  Dottie Dolan moved to approve the deviation of the plan for Jamie Johnson for the screened porch; seconded by Cyndi Moe; passed 6-0.

·       The Commission briefly reviewed the proposed zoning bylaw amendments; the Selectmen have requested the Commission’s recommendation for the Special Town Meeting.  Denny O’Connell will come to the October 15, 2008 meeting to discuss the proposed changes so the Commission can make a more-informed response.

·       September 3, 2008 meeting minutes were reviewed but not approved.

Public Hearings 5:00 pm:
Cataldo, 97 Pine Point Rd, Map 21, Parcel 52, RDA, replace block wall with boulder wall.  John DiBlasio recused himself.   Jeff Carlson represented the applicant and gave an overview of the project, stating there will be no water drainage into the harbor and the concrete will be removed from the site.  Work will not go beyond the current footprint.  Dottie Dolan moved to identify this RDA as a Negative 3; seconded by Cyndi Moe; passed 5-0.  

5:10 pm
120 Blue Heron Road, Map 42, Parcel 133:  AOOC, new septic design and new dwelling. David Lajoie represented the applicant and gave an overview of the project.  A generic house plan was approved and the new owners have modified the house plans.  The owners will install composting toilets so that they can build a three-bedroom house on a lot zoned for two. Agent Greenberg requested the house be set 10 feet closer to Blue Heron Road.  Abutters Multer stated the frontage is based on a paper road. Cyndi Moe moved to approve the Amended Order of Conditions; seconded by John DiBlasio; passed 6-0.

Cape Cod National Seashore, 235 Way #625, Map 16, Parcel 630, RDA, replace deck and access ramp
At the request of the applicant, Cyndi Moe moved to continue to 11/5/08; seconded by John DiBlasio; passed 6-0.

5:30 pm
MA Audubon, NOI, off Lt. Island, create oyster reef (Cont’d from 7/02/08).  Bob Prescott stated there will be no letter from DMF and a permit was received from DMF.  The State wants the MA Audubon to be a sub-permittee under the Town since oysters will not be collected in the standard manner.  Prescott stated there will be a steering and advisory committee to provide advice on collecting oysters. The area was resurveyed on 7/29/08 and Prescott pointed out that the rocks that in the area will protect the reef.  Prescott provided material identifying monitoring and sampling currently being performed.  No surveys on the plants, animals and biology have been performed since the 1970’s and new studies will be performed.   If this project is successful, it will serve as guidelines for the state.  For any future changes, an Amended Order of Conditions would have to be filed.  No ENF will have to be filed.  Patrick Winslow moved to approve the NOI; seconded by Ed Reynolds; passed 6-0.  Patrick Winslow Supervisor.

Kew, 82 Wiles Lane, Map 16, Parcel 631, NOI, Install wood staircase from cottage to beach.  Cyndi Moe moved to continue to 11/5/08 at the request of the applicant; seconded by Dottie Dolan; passed 6-0.

Other:

·       Bob Prescott stated there was a successful turtle garden at MA Audubon and there are 12 hatchlings.  A future workshop garden turtles is scheduled for the January / March 2009 timeframe.

Patrick Winslow moved to adjourn at 6:05 pm ; seconded by John DiBlasio; passed 6-0..
